The present provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) that the company Zapateli, S.L., (hereinafter, Eli 1957) makes available to Internet users. Eli 1957 is a limited company of Spanish nationality and indefinite duration, with registered offices at Autovía Levante, Km 53 (via servicio) - 03400 Villena, Alicante. Access to the website is free of charge except for the cost of connection through the telecommunications network supplied by the access provider contracted by users. The website has restricted areas for the exclusive use of registered customers. Only customers registered on the Portal will have access to this area of the Website. The use of the Portal confers the condition of user of the Portal (hereinafter, the ‘User’) and implies acceptance of all the conditions included in the ‘Privacy Policy’ that is in force at this address. The provision of the Portal service is limited to the time at which the User is connected to the Portal or to any of the services provided through it.

Therefore, the User must read this Privacy Policy carefully each time he/she intends to use the Portal, as the conditions set out in this Privacy Policy may be subject to change.

Intellectual and industrial property

https://eli1957.com is the Web Portal of Eli 1957, through which various information services and on-line product sales are provided to its visitors. By visiting and using the Portal, you accept the fact that its owner reserves the right to modify or suspend the available pages, the website, or to temporarily or permanently delete the data it has offered, at any time, without prior notice and without any liability to the Users.

In this way, you accept that Eli 1957 has no responsibility whatsoever for the deletion of information, failures in its storage, inaccuracy of the contents and other circumstances relating to the information on its website. Portal's terms of use

3.1 General

The User undertakes to make correct use of the Portal in accordance with the applicable Laws and this Privacy Policy. The User shall be liable to Eli 1957 or to third parties for any damages that may be caused as a result of non-compliance with this obligation.

Likewise, the User, when ordering products through the Web Portal, is subject to the conditions in force at any given time, and the User undertakes to comply with the conditions established at any given time. It is expressly forbidden to use the Portal for purposes harmful to the property or interests of Eli 1957 or third parties or that in any other way overload, damage or render useless the networks, servers and other computer equipment (hardware) or computer products and applications (software) of Eli 1957 or third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the applicable Laws, the conditions in force, and this Privacy Policy. By way of example only, the User, in accordance with current legislation, shall refrain from:

Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents except in cases authorised by law or expressly consented to by Eli 1957 or by whoever holds the ownership of the exploitation rights, where applicable.
Reproduce or copy for private use the Contents that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these acts necessarily imply reproduction by the User or a third party.

3.3 Data collection forms

Without prejudice to the provisions of clause 5 of this Privacy Policy, the use of certain services or requests addressed to Eli 1957 may be conditional upon the prior completion of the corresponding request form by the User. All information provided by the User through the Portal forms for the above or any other purposes must be truthful.

For these purposes, the User guarantees the authenticity of all the data provided, and will keep the information provided to Eli 1957 perfectly updated so that it corresponds, at all times, to the real situation of the User. In any case, the User shall be solely responsible for any false or inaccurate statements made and for any damage caused to Eli 1957 or third parties as a result of the information provided. In order to provide the data to Eli 1957, the User must also have all the authorisations required by current legislation at all times, and shall be liable to Eli 1957 and/or any third party for any contingency that may arise from the lack of authorisation.

3.4 Introduction of links to the Portal

Users who wish to introduce links from their own web pages to the Portal must comply with the conditions detailed below, without ignorance of these conditions avoiding the responsibilities derived from the Law: The link will only link to the home page or main page of the Portal but may not reproduce it in any way (inline links, copy of texts, graphics, etc). It shall be prohibited in any case, in accordance with the applicable legislation in force at any given time, to establish frames of any kind that surround the Portal or allow the Contents to be viewed through Internet addresses other than those of the Portal and, in any case, when they are displayed together with contents outside the Portal in such a way that: (I) produces, or may produce, error, confusion or deception in users as to the true origin of the service or Contents; (II) involves an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of and prestige of Eli 1957; or (IV) in any other way is prohibited by current legislation.

The page that introduces the link shall not make any false, inaccurate or incorrect statements about Eli 1957, its employees, or about the quality of the services it provides. Under no circumstances shall it be stated on the page where the link is located that Eli 1957 has given its consent to the insertion of the link or that it otherwise sponsors, collaborates with, verifies or supervises the services of the sender. Exclusion of liability

4.1 Quality of service

Access to the Portal does not imply any obligation on the part of Eli 1957 to check for the absence of viruses, worms or any other harmful computer element. It is the responsibility of the User, in any case, to ensure the availability of adequate tools for the detection and disinfection of harmful computer programs. Eli 1957 shall not be liable for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.2 Availability of the Service

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks, the reliability, quality, continuity and operation of which are not the responsibility of Eli 1957. Consequently, the services provided through the Portal may be suspended, cancelled or become totally or partially inaccessible, permanently or temporarily, prior to or simultaneously with the provision of the Portal service. Eli 1957 is not responsible for damages or losses of any kind caused to the User, caused by failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during or prior to the provision of the same.

4.3 Content and services linked through the Portal

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In any case, and in the cases that are applicable, with respect to the Linked Sites Eli 1957 acts as a provider of intermediation services in accordance with article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSI), and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence.

In the event that the User considers that there is a Linked Site with illegal or inappropriate content, he/she may notify Eli 1957, in which case Eli 1957 will carry out the appropriate investigations in order to remove or disable, where appropriate, the corresponding link. In no case shall the existence of Linked Sites presuppose the existence of agreements with the persons responsible for or owners of the same, nor the recommendation, promotion or identification of Eli 1957 with the statements, content or services provided. Eli 1957 is not aware of the content and services of the Linked Sites, as they are constantly updated and modified, and therefore is not responsible for any damage caused by the illegality, quality, outdatedness, unavailability, error and uselessness of the content and/or services of the Linked Sites, or for any other damage that is not directly attributable to Eli 1957.

4.4 User Responsibility

The User acknowledges sole responsibility for his or her use of the Website in accordance with this Privacy Policy and holds Eli 1957 harmless from any claim or demand, including but not limited to legal representation fees, that may be brought by any third party due to or arising out of his or her conduct or connection to this Website, the content it offers, his or her violation of this Privacy Policy or any other violation of the rights of any other person or party.

4.5 General limitation of liability

Applicable law

By using this website you agree that this Privacy Policy, the Terms of Use, and any dispute relating to the use of this Portal, will be interpreted in accordance with the laws in force in the place of residence of the owner of this website, that is, Spanish laws. Likewise, the User, waiving any other jurisdiction that may apply, submits to the jurisdiction of the courts and tribunals of the city of Alicante, for any dispute or controversy that may arise in relation to this Privacy Policy, the Terms of Use and, in general, for the use of the Portal or for all the services provided by Eli 1957.
